Terms of Service
Draft — pending legal review. This page describes how Yooseum works today in plain language; it is not yet a lawyer-reviewed legal document.
1. What Yooseum is
Yooseum is a private, family-oriented app for sharing photos, videos, and memories on a shared timeline. You control who can see what you post, from just yourself up to friends and family you've connected with. Yooseum is operated by No-Lyfe Media ("we," "us," "our") — you'll see that name on your billing statement, as described below. Using Yooseum means you accept these Terms and our Privacy Policy.
2. Your account and content
You're responsible for keeping your account credentials confidential and for the accuracy of what you post — notify us right away if you suspect someone else has accessed your account without permission. You retain ownership of the photos, videos, and text you upload. By posting content, you grant Yooseum only the license needed to store, process, and display it to the people you've chosen to share it with, according to your visibility settings — we don't use, license, or sell your content beyond that. You represent that you have the right to post whatever you upload, including any photos or descriptions involving other people, and that doing so doesn't violate anyone else's rights.
3. Acceptable use
Use Yooseum for its intended purpose — sharing your own family's memories. Don't upload content you don't have the right to share, content that's illegal, defamatory, or infringes someone else's copyright, or content intended to harass or harm others. Don't attempt to access accounts, events, or media you don't have permission to see, and don't upload viruses or malicious code or otherwise try to disrupt the service. Violations may result in content removal or account suspension, and illegal activity may be referred to law enforcement. Uploading material found to be obscene, pornographic, or illegal is subject to immediate removal of the material, suspension of your account, and/or notification to legal authorities, as appropriate.
4. Not a backup service
Yooseum is a sharing and memory-keeping app — it is not sold or intended as a backup service. We take reasonable care with your data, but we don't guarantee permanent, durable retention. You should keep your own copies of photos and videos that matter to you. Yooseum disclaims liability for unintentional data loss.
5. Subscriptions and billing
Free accounts can upload a limited number of photos and videos. Paid subscriptions remove that limit and are billed through our payment processor, Helcim — we don't store your card details ourselves, and we aren't responsible for outages or errors on Helcim's end. Charges will appear on your card or bank statement under the name No-Lyfe Media, the company that operates Yooseum — not "Yooseum" itself, so don't be alarmed if you see that name instead. Founding pricing, where offered, is available to a limited number of early subscribers and is not guaranteed to remain available or to be offered again. You can cancel a paid subscription at any time; cancelling stops future billing, but we don't provide refunds for the current billing period already paid for.
6. Inviting others
If you add someone's email address to your People list and they're not already on Yooseum, we'll send them an email invitation on your behalf. We don't send text-message invites — sending unsolicited texts requires the recipient's prior consent under U.S. law, and we follow and agree with that law.
7. Copyright and infringement claims
If you believe content on Yooseum infringes your copyright, contact us with: a description and location of the copyrighted work and the infringing material, your contact information, a statement that you have a good-faith belief the use is unauthorized, and a statement, made under penalty of perjury, that the information is accurate and that you're authorized to act on the copyright owner's behalf. We'll remove or disable access to material we determine infringes. If you believe your own content was removed in error, you may send a counter-notice identifying the material and including a statement, under penalty of perjury, that you have a good-faith belief it was removed by mistake.
8. Disclaimer and limitation of liability
Yooseum is provided "as is," without warranties of any kind, express or implied. To the fullest extent permitted by law, Yooseum isn't liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim relating to Yooseum is limited to the greater of $50 or the amount you paid us in the 12 months before the claim arose.
9. Indemnity
You agree to indemnify and hold Yooseum harmless from claims, damages, and expenses (including reasonable legal fees) arising from your use of the service, content you post, or your violation of these Terms — including claims brought by someone you've tagged or pictured in content you upload.
10. Dispute resolution
Any claim relating to Yooseum must be filed within six months of the event giving rise to it, or it is permanently waived. Claims may only be brought individually, not as part of a class, consolidated, or representative action.
11. Termination and discontinuation of service
You may stop using Yooseum at any time. We may suspend or terminate accounts that violate these terms. We may also modify, suspend, or discontinue Yooseum entirely, or transfer it to another party, at any time. Sections of these Terms that by their nature should survive termination — including content licensing already granted, disclaimers, limitation of liability, and indemnity — continue to apply after your account is closed.
12. General provisions
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver of it. Section headings are for convenience only and don't affect interpretation. If these Terms conflict with another Yooseum policy, these Terms control.
13. Changes to these terms
We may update these terms as Yooseum changes. We'll post the updated version here; continuing to use Yooseum after an update means you accept the revised terms.
